GENERAL TERMS & CONDITIONS

These terms and conditions apply to all contracts of Solar Gaps Nigeria. Limited.

The End User/Buyer may only take recourse to stipulations deviating from these conditions if and to the extent that these are accepted in writing by SolarGaps.

SolarGaps provides a Limited Product Warranty applicable to PV modules and applicable solely to the original End User/Buyer and the subsequent owner(s) of the location where the PV modules were originally installed.

With regards to the Limited Warranty on Peak Performance, the Peak Performance in watts applies that a PV module generates at the maximum performance the power actually delivered by the PV modules will be established for verification solely under Standard Test Conditions. The measurement of the issued power will be carried out either by SolarGaps or by an authorized third-party testing body recognised by SolarGaps. Test equipment tolerances will be applied to all actually issued power measurements.

1. THE WARRANTY

The Limited Product Warranty provided by SolarGaps, and the Limited Warranty on Peak Performance only cover claims from the End User/Buyer that are received in writing by SolarGaps during the Warranty Period. The transport costs related to defective PV modules or repaired or replaced PV modules will be borne in equal shares by Parties, whereby the End User/Buyer shall pay the costs of installation, removal, or re-installation of the PV system. The Limited Product Warranty and the Limited Warranty on Peak performance therefore covers the transport costs for the return of the repaired or replacement module(s) to the location of the End User/Purchaser, but do not cover transport costs and risks, including transport damage or loss before the return of the module(s) to SolarGaps or an authorized agent of SolarGaps and any other costs of installation, removal, or reinstallation of the module(s). If a module that has been returned to SolarGaps proves not to be defective or if the Warranty Period has passed; the End User/Buyer is responsible to pay the return costs. With regards to claims in the context of a warranty, the original invoice must be submitted.

Repairs or replacements of PV modules and/or other components will not result in an extension of the valid warranty period; the original warranty period still applies. The claims on the warranties as referred to in these General Warranty Terms and Conditions constitute the only claims for the End User/Buyer.

2. WARRANTY EFFECTIVE DATE

The effective date of the warranties provided herein shall be the date of installation by SolarGaps to the original End User/Buyer.

3. EXCEPTIONS

The limited warranties set forth herein DO NOT apply to any Products:

For which SolarGaps has not received all or part of the due payments from the Buyer.

Which have been subject to negligence in transportation, handling, storage, or use.

Which have been repaired without SolarGaps’s authorization or in any way tampered with.

Which have been subject to extraordinary salt or chemical exposure.

Which have been subject to improper installation, application, alteration, unauthorized service, or improper system design which caused constant shading to the Products.

Which have been subject to power failure or surges, flood, fire, direct or indirect lightning strikes, or other acts of nature.

Which have been subject to accidental breakage, vandalism, explosions, acts of war, or other events outside SolarGaps’s control.

Which have been moved from its original installation location.

In addition, the limited warranties do not apply to any deterioration in the appearance of the products (including, without limitation, any scratches, stains, rust, discoloration, or mould) or any other changes to the Products in appearance stemming from the normal wear and tear over time of the product materials. Also, no warranty claims may be made if the product label, type, or serial number of the applicable products have been altered, removed, or made illegible.
